A Sidmouth pensioner, who was served with a council notice to stop her feeding birds, is continuing to fight the order in court.
Rose Rodell’s case went before Exeter Magistrates’ Court again last week as the 70-year-old continues her appeal against the community protection notice issued by East Devon District Council (EDDC).
The notice was served in March this year and refers to the ‘feeding of birds with grain, peanuts and other food within the area of Sidmouth’, which the council says is ‘affecting the properties and wellbeing of residents of Sidmouth’.
The hearing on Tuesday, October 6, was told that EDDC would be calling two witnesses, including a member of the authority’s environmental health team. York Street resident Mrs Rodell represented herself.
The matter will come before the court again in December, when a judge will hear both sides of the case before making a decision on whether to revoke the order.
